The Court of Protection was set up with the aim of safeguarding the health, welfare and financial affairs of those who lack capacity to deal with those aspects themselves and can include some of the most vulnerable members of society and their families.

We have a very experienced Court of Protection department led by one of our partners, Cathy MacCracken, who is a member of the Court of Protection approved Panel of Deputies and currently only one of a handful of panel deputies in Lancashire.

Cathy and her team look after the financial affairs of people who are unable to make decisions for themselves about their property and financial affairs. For example this may be as a result of an acquired brain injury, an injury at birth, or dementia or Alzheimer’s disease.

How much does it cost?

The cost of the application varies according to the type of case, but factors taken into consideration are the person’s assets and whether or not the application is likely to be challenged.

Once an assessment of your circumstances has been carried out, we will explain the costs involved and give you information about the funding options available to you. Sadly, public funding is not available for property and affairs applications to the Court of Protection, but you may be exempt from paying court fees in certain circumstances and we will advise on whether this applies to you.

We offer flexible arrangements and will always provide a detailed cost estimate in writing at the outset. We will update you regularly and help you to budget.
