Do I need a Lasting Power of Attorney?

A lasting power of attorney (LPA) is a legal document that allows you to choose someone who will be able to make decisions for you if you were no longer able to make them yourself. They are known as attorneys. This person is likely to be a friend or family member who you trust. However, if you don’t have a suitable person to ask, you can ask a professional such as a teacher or solicitor. For extra security, you can choose more than one person to act either together or separately. Whoever you choose, they must only make decisions in your best interests when it comes to your health, housing, care and finances.  

There are two types of LPA, a ‘health and welfare’ and another that covers your ‘property and financial affairs’. An LPA can only be made when you still have full mental capacity. So if you do decide to make one, the sooner you do so the better. We recommend that you have both in place as they focus on two separate and distinct areas of your life.
