Nightclub Assault Claims

Alcohol or drug-related assault, especially in nightclubs, is sadly a common occurrence in the UK. If you have been injured by an assailant on a night out, and you haven’t provoked or caused the attack in any way , then you could file a claim for compensation from the Criminal Injury Authority (CICA) under their 2012 scheme.

Making a claim for your attack will not, in itself, result in any punishment against the attacker though any criminal conviction if the attacker is caught of course could do. It does however give you the means to obtain financial help, as your physical and psychological injuries may impact your life for years to come.

Can I claim compensation for an assault even if I don’t know who attacked me?

Yes, you can still apply for compensation through CICA even if you don’t know the identity of your assailant.

What evidence do I need to support my domestic assault claim?

There are many pieces of evidence you can use to support your domestic assault claim, including:

  • Photos of injuries sustained from physical abuse
  • Medical records for your treatment
  • Prescriptions for any medications you needed
  • Witness statements
  • Threatening texts, emails or social media messages
  • A copy of the Police report
  • CCTV footage

How long do I have to claim?

The time limit to make a nightclub assault claim is up to 2 years from the date on which it was reported to the police. Your assailant doesn’t need to be convicted for you to make a claim, nor do you need to know the identity of your assailant – as long as the police have a report on file for the incident, and you have a crime reference number, you can make a claim.

How much will I get for my nightclub assault claim?

The amount you could receive for your nightclub assault claim depends on the severity and consequences of your injury (financial or otherwise). The minimum you can claim is £1000, while the maximum you can claim before reductions is up to £500,000 before reductions. At Birchall Blackburn Law we will always try to secure the highest possible amount for your nightclub assault claim.

How long does a nightclub assault claim take?

The CICA endeavours to make a decision on most claims within 2-3 years. The general rule is the more complex your case, the longer it will take for the CICA to come to a decision.

If your claim is successful and you have accepted the CICA’s proposed offer, then the monies should be in your bank account in 3 – 4 weeks.
