Pre and Post Nuptial Agreements
For couples who have recently married or who are preparing for their upcoming wedding, planning for a possible future breakdown of the marriage may not seem like a very romantic idea. However pre-nuptial and post-nuptial agreements may be a sensible and appropriate option for you.
These agreements are often technically complex and they can address thorny issues relating to personal or business property and assets owned by the individuals before their marriage.
Such formal agreements can be carefully drafted by our team of expert family lawyers to accurately reflect who owned what at the time of the marriage and also how those assets should be divided in the event of a divorce or judicial separation.
A pre- or post-nuptial agreement may be appropriate for you if:
- you have children from a previous relationship
- you have been divorced before
- you have significant personal assets compared to your future spouse
Whilst it is important to remember that neither type of agreement is currently legally binding in England and Wales, recent cases law has resulted in the court attaching considerable weight to such agreements in certain circumstances.
