Sexual Assault Claims

While we know compensation for sexual abuse won’t undo what has happened, it can help you start to rebuild your life. Our specialist solicitors have years of experience in dealing with sexual abuse cases, so you can be assured we will deal with your case conscientiously and sensitively.

What is sexual assault?

A sexual assault is any sexual act that a person did not consent to, or is forced into against their will. It is a form of sexual violence and includes rape, or other sexual offences, such as groping, forced kissing or child sexual abuse.

Strict confidentiality

We know confidentiality is one of the top priorities for you – we don’t want you to worry about discussing your claims with one of our specialists. Our compassionate team will deal with your case with the utmost care.

How long do I have to claim?

We know it can be extremely traumatic reporting sexual assault or rape and it can be hard to find the words to explain to your loved ones what has happened, let alone the authorities. You should only tell the police when you’re ready. However, the sooner you can manage to do so the sooner people can start helping you to deal with what has happened.

Unfortunately, there is a time limit to sexual assault claims. The time limit to make a claim for sexual assault is within 2 years of the date of the assault or the date it was reported to the police if there was reasonable cause to the delay in doing so.

However, if the victim of the sexual assault was / is a child, they have 2 years from the age of 18 to make a claim – unless someone else made a claim for them on their behalf.

What evidence do I need to support my claim?

Evidence that could help your claim could include:

  • Police evidence
  • Medical and forensic evidence
  • Emails, texts, etc (if applicable)
  • Witness statements dealing with the effect it has had upon you
  • Report/records from any treating therapists

How much will I get for my claim?

No amount of money will undo what any victim of sexual assault or rape has had to endure and no level of compensation will make the person feel any differently. However, the compensation our team of solicitors at Birchall Blackburn can help to relieve some of the financial strain. For example, if the person hasn’t been able to face returning to work or has to pay for specialist therapy to deal with the effects of it. We want to help victims start to see things a little differently and build their lives one step at a time.
